Terms of Service

These Terms of Service (the "Terms") govern your access to and use of Gym Register: the website at gym-register.com, the student app (student.gym-register.com and its mobile versions) and the admin app (admin.gym-register.com), together the "Service". Gym Register ("Gym Register", "we", "us") provides the Service.

By creating an account, signing in, scanning a setup or check-in code, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service. Please also read our Privacy Policy, which explains how personal data is handled.

1. The Service and who is who

Gym Register is software for gyms and fitness studios ("Gyms"). Gyms and their staff ("Admins") use it to record attendance, manage memberships, plans and renewals, organize class schedules and group sizes, and accept class reservations. The Gym's members ("Students") use it to check in, follow their plan and, where the Gym enables it, reserve classes.

Gym Register provides software only. Your membership, its price and conditions, the Gym's rules, the classes, the facilities, instruction and supervision are matters between the Student and the Gym. We are not a party to those arrangements and are not responsible for them.

2. Accounts and access

  • Who creates accounts. A Gym's Admin registers its Students. Gym Admin accounts are created by Gym Register or by another Admin of the same Gym. You cannot create an account for yourself in the apps.
  • First access. A new account receives either a one-time setup link or QR code, or a temporary password. Each works once, a setup link expires after 24 hours, and you must use it to choose your own password. If it is used up or expires before you finish, ask the Gym to restore your access and issue a new one.
  • Keep your account secure. Give us accurate information, keep your password and any setup link or QR code confidential, do not share your account, and tell the Gym or us promptly if you suspect unauthorized use. You are responsible for activity under your account.
  • One login, several gyms. A Student who belongs to more than one Gym uses a single login. Restoring access from one Gym resets that shared password for all of them.
  • Minors. A person under 18 must be registered by a parent or legal guardian, who accepts these Terms and the Privacy Policy on the minor's behalf, provides their own contact details, and remains responsible for the minor's use of the Service.

3. Acceptable use

You agree not to:

  • use the Service unlawfully or in a way that infringes the rights of others;
  • access, or try to access, another Gym's data or another person's account;
  • check in for someone else, check in without actually attending, or otherwise record false attendance;
  • probe, scan or test the Service's security, overload it, or interfere with its operation;
  • use bots, scrapers or other automated means, except through interfaces we provide for that purpose;
  • copy, modify, reverse engineer or create derivative works of the Service, except where the law allows it despite this restriction;
  • upload a logo, name or other content you have no right to use, or that is unlawful, misleading or offensive.

4. Check-ins, plans and reservations

  • Rules come from the Gym. Weekly and per-cycle visit limits, plan dates, renewal and expiry policies and class capacity are set by the Gym. The Service applies them, and the Gym's Admins can add, change or remove attendance records by hand.
  • Codes. Check-in QR codes and short codes are valid only for the class or day they are shown for, and one check-in per day counts toward a plan. They are for people who are present at the Gym.
  • Reservations. Where a Gym enables them, reservations hold a place in a class. They depend on the group size the Gym sets, are not guaranteed beyond what the Gym provides, and may be cancelled by the Student until the class starts. A Gym may change or cancel classes and may turn away people without a reservation when a class is full.
  • Records. Attendance and membership records are working records kept by the Gym. If one is wrong, ask the Gym to correct it.

5. Payments

Gym Register does not process membership payments and does not receive or store card or bank details. The Service only lets a Gym record that a payment was received, for which plan and period. Prices, payment methods, refunds and any disputes about memberships are between the Student and the Gym.

6. Additional terms for gyms

  • Fees. A Gym's use of the Service is subject to the commercial terms agreed with us, for example a fee per active student invoiced for a period. Invoices are due as stated on them. If an invoice is unpaid after notice, we may display payment reminders in the admin app and, if it remains unpaid, suspend the Gym's access.
  • Data responsibilities. The Gym decides why and how its members' personal data is used and is responsible for having the authorization the law requires, including a guardian's authorization for minors, and for the accuracy of what its Admins enter. Gym Register processes that data on the Gym's behalf, as described in the Privacy Policy.
  • Staff. The Gym is responsible for who it gives Admin access to, for keeping that access limited to its staff, and for asking us to remove people who have left.
  • Branding and content. The Gym keeps ownership of its name, logo and colors and gives us a limited licence to host and display them to its members through the Service. The Gym confirms it has the right to do so.
  • Its own policies. The Gym is responsible for its own cancellation, age, health and safety policies and for informing its members of them.
  • Suspension. If a Gym is suspended, its Admins and Students cannot use the Service for that Gym until it is restored.

7. Health and safety

The Service does not give medical or fitness advice. Physical activity carries risk. Each Student is responsible for their own health and for talking to a professional before exercising where appropriate. The Gym is responsible for its facilities, equipment, instruction and supervision. To the extent the law allows, Gym Register is not liable for injuries or health matters arising from activity at a Gym.

8. Intellectual property

The Service, including its software, design, name and logo, belongs to Gym Register and its licensors. We give you a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms. Content that Gyms and Students provide remains theirs. If you send us suggestions, we may use them without obligation to you.

9. Privacy

Our Privacy Policy explains what personal data the Service handles, why, and your rights, including how Students can obtain a copy of their data or have their profile deleted from the Account page.

10. Availability and changes to the Service

We work to keep the Service available but do not promise uninterrupted or error-free operation. We may perform maintenance, and we may change, add or remove features. If a change materially affects Gyms, we will try to give reasonable notice.

11. Suspension and termination

We may suspend or end access to the Service, or to an account or Gym, if these Terms are breached, if required for security or by law, or if a Gym's commercial terms end. A Gym may stop using the Service at any time. A Student may delete their profile from the Account page or ask the Gym to do so. What happens to data afterwards is described in the Privacy Policy. Sections that by their nature should continue (for example intellectual property, disclaimers, limitation of liability and governing law) survive termination.

12. Disclaimers

To the extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind beyond those that cannot be excluded. Nothing in these Terms limits the rights you have as a consumer under Colombian law, including Law 1480 of 2011 (Consumer Statute).

13. Limitation of liability

To the extent permitted by law, Gym Register is not liable for indirect, incidental, special or consequential damages, or for loss of profits, revenue, data or goodwill. The Service is provided to Students free of charge by us; to the extent permitted by law our total liability to a Student is limited accordingly. For a Gym, our total liability for all claims relating to the Service is limited to the amount that Gym paid us in the twelve months before the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for fraud, willful misconduct or gross negligence, or for death or personal injury caused by our fault.

14. Indemnity (gyms)

A Gym will defend and compensate Gym Register against third-party claims, and related costs, arising from content the Gym provides, from the Gym's processing of personal data without the authorization the law requires, or from the Gym's breach of these Terms.

15. Changes to these Terms

We may update these Terms. The current version is always at this address with its date. If a change is material, we will notify users through the Service or by other means we have. Using the Service after a change takes effect means you accept the updated Terms. If you do not accept them, stop using the Service and ask for your account to be deleted.

16. Governing law and disputes

These Terms are governed by the laws of the Republic of Colombia. If you have a concern, please contact us first so that we can try to resolve it amicably. Disputes that cannot be resolved that way are subject to the competent courts of Colombia. Consumers keep any right to turn to the competent consumer-protection authority, and everyone keeps the right to complain to the data-protection authority described in the Privacy Policy.

17. General

These Terms, together with the Privacy Policy and any commercial agreement we have with a Gym, are the entire agreement about the Service. If part of these Terms is found unenforceable, the rest remains in effect. A failure to enforce a right is not a waiver of it. We may assign these Terms in connection with a business transfer; you may not assign them without our consent. These Terms are provided in English and Spanish; if the two differ, the Spanish version prevails.

Estos Términos del servicio (los "Términos") regulan el acceso y uso de Gym Register: el sitio web gym-register.com, la app de estudiantes (student.gym-register.com y sus versiones móviles) y la app de administradores (admin.gym-register.com), en conjunto el "Servicio". Gym Register ("Gym Register", "nosotros") presta el Servicio.

Al crear una cuenta, ingresar, escanear un código de configuración o de asistencia, o usar de cualquier otra forma el Servicio, aceptas estos Términos. Si no estás de acuerdo, por favor no uses el Servicio. Lee también nuestra Política de privacidad, que explica cómo se tratan los datos personales.

1. El Servicio y quién es quién

Gym Register es un software para gimnasios y estudios de entrenamiento ("Gimnasios"). Los Gimnasios y su personal ("Administradores") lo usan para registrar la asistencia, administrar membresías, planes y renovaciones, organizar horarios y tamaños de grupo de las clases y recibir reservas. Los miembros del Gimnasio ("Estudiantes") lo usan para marcar su entrada, seguir su plan y, cuando el Gimnasio lo habilita, reservar clases.

Gym Register ofrece únicamente el software. La membresía, su precio y condiciones, las reglas del Gimnasio, las clases, las instalaciones, la instrucción y la supervisión son asuntos entre el Estudiante y el Gimnasio. No somos parte de esos acuerdos ni respondemos por ellos.

2. Cuentas y acceso

  • Quién crea las cuentas. Un Administrador del Gimnasio registra a sus Estudiantes. Las cuentas de Administrador las crea Gym Register u otro Administrador del mismo Gimnasio. No puedes crear una cuenta por tu cuenta en las apps.
  • Primer acceso. Una cuenta nueva recibe un enlace o código QR de configuración de un solo uso, o una contraseña temporal. Cada uno funciona una sola vez, el enlace de configuración vence a las 24 horas y debes usarlo para elegir tu propia contraseña. Si se agota o vence antes de que termines, pide al Gimnasio que restablezca tu acceso y emita uno nuevo.
  • Protege tu cuenta. Danos información veraz, mantén en reserva tu contraseña y cualquier enlace o código QR de configuración, no compartas tu cuenta y avisa pronto al Gimnasio o a nosotros si sospechas un uso no autorizado. Eres responsable de la actividad de tu cuenta.
  • Un acceso, varios gimnasios. Un Estudiante que pertenece a más de un Gimnasio usa un solo acceso. Restablecer el acceso desde un Gimnasio cambia esa contraseña compartida para todos.
  • Menores de edad. Una persona menor de 18 años debe ser registrada por su padre, madre o representante legal, quien acepta estos Términos y la Política de privacidad en nombre del menor, aporta sus propios datos de contacto y sigue siendo responsable del uso del Servicio por parte del menor.

3. Uso aceptable

Te comprometes a no:

  • usar el Servicio de forma ilegal o que infrinja derechos de otras personas;
  • acceder, o intentar acceder, a datos de otro Gimnasio o a la cuenta de otra persona;
  • marcar la entrada de otra persona, marcarla sin asistir realmente o registrar de cualquier forma una asistencia falsa;
  • sondear, escanear o probar la seguridad del Servicio, sobrecargarlo o interferir con su funcionamiento;
  • usar robots, extractores u otros medios automatizados, salvo mediante las interfaces que dispongamos para ello;
  • copiar, modificar, aplicar ingeniería inversa o crear obras derivadas del Servicio, salvo donde la ley lo permita a pesar de esta restricción;
  • cargar un logo, nombre u otro contenido que no tengas derecho a usar, o que sea ilícito, engañoso u ofensivo.

4. Asistencia, planes y reservas

  • Las reglas las define el Gimnasio. Los límites de visitas por semana y por ciclo, las fechas del plan, las políticas de renovación y vencimiento y el cupo de las clases los fija el Gimnasio. El Servicio los aplica y los Administradores del Gimnasio pueden agregar, cambiar o eliminar registros de asistencia manualmente.
  • Códigos. Los códigos QR y los códigos cortos de asistencia solo sirven para la clase o el día para el que se muestran, y cuenta una entrada por día para un plan. Son para personas que están presentes en el Gimnasio.
  • Reservas. Cuando un Gimnasio las habilita, las reservas guardan un cupo en una clase. Dependen del tamaño de grupo que defina el Gimnasio, no están garantizadas más allá de lo que este ofrezca y el Estudiante puede cancelarlas hasta que empiece la clase. Un Gimnasio puede modificar o cancelar clases y puede no admitir a personas sin reserva cuando una clase está llena.
  • Registros. Los registros de asistencia y membresía son registros de trabajo que lleva el Gimnasio. Si alguno es incorrecto, pide al Gimnasio que lo corrija.

5. Pagos

Gym Register no procesa pagos de membresías ni recibe o guarda datos de tarjetas o cuentas bancarias. El Servicio solo permite al Gimnasio registrar que recibió un pago, de qué plan y de qué periodo. Los precios, medios de pago, reembolsos y cualquier controversia sobre las membresías son entre el Estudiante y el Gimnasio.

6. Condiciones adicionales para gimnasios

  • Tarifas. El uso del Servicio por un Gimnasio está sujeto a las condiciones comerciales acordadas con nosotros, por ejemplo una tarifa por estudiante activo facturada por periodo. Las facturas se pagan según lo indicado en ellas. Si una factura sigue sin pagarse tras el aviso, podemos mostrar recordatorios de pago en la app de administradores y, si persiste, suspender el acceso del Gimnasio.
  • Responsabilidades sobre los datos. El Gimnasio decide para qué y cómo se usan los datos personales de sus miembros y es responsable de contar con la autorización que exige la ley, incluida la de los representantes legales de los menores, y de la exactitud de lo que ingresan sus Administradores. Gym Register trata esos datos por cuenta del Gimnasio, como se describe en la Política de privacidad.
  • Personal. El Gimnasio es responsable de a quién da acceso de Administrador, de limitarlo a su personal y de pedirnos que retiremos a quienes ya no trabajan allí.
  • Marca y contenido. El Gimnasio conserva la titularidad de su nombre, logo y colores y nos otorga una licencia limitada para alojarlos y mostrarlos a sus miembros a través del Servicio. El Gimnasio declara que tiene derecho a hacerlo.
  • Sus propias políticas. El Gimnasio es responsable de sus políticas de cancelación, edad, salud y seguridad y de informarlas a sus miembros.
  • Suspensión. Si un Gimnasio es suspendido, sus Administradores y Estudiantes no pueden usar el Servicio para ese Gimnasio hasta que se restablezca.

7. Salud y seguridad

El Servicio no da asesoría médica ni deportiva. La actividad física conlleva riesgos. Cada Estudiante es responsable de su propia salud y de consultar a un profesional antes de hacer ejercicio cuando corresponda. El Gimnasio es responsable de sus instalaciones, equipos, instrucción y supervisión. En la medida que la ley lo permita, Gym Register no responde por lesiones o asuntos de salud derivados de la actividad en un Gimnasio.

8. Propiedad intelectual

El Servicio, incluidos su software, diseño, nombre y logo, pertenece a Gym Register y a sus licenciantes. Te otorgamos una licencia limitada, no exclusiva, intransferible y revocable para usar el Servicio conforme a estos Términos. El contenido que aportan los Gimnasios y los Estudiantes sigue siendo suyo. Si nos envías sugerencias, podemos usarlas sin obligación alguna hacia ti.

9. Privacidad

Nuestra Política de privacidad explica qué datos personales trata el Servicio, para qué y cuáles son tus derechos, incluido cómo los Estudiantes pueden obtener una copia de sus datos o eliminar su perfil desde la página Cuenta.

10. Disponibilidad y cambios del Servicio

Trabajamos para mantener el Servicio disponible, pero no prometemos un funcionamiento ininterrumpido ni libre de errores. Podemos hacer mantenimiento y podemos cambiar, agregar o retirar funciones. Si un cambio afecta de forma importante a los Gimnasios, procuraremos dar un aviso razonable.

11. Suspensión y terminación

Podemos suspender o terminar el acceso al Servicio, a una cuenta o a un Gimnasio si se incumplen estos Términos, si es necesario por seguridad o por ley, o si terminan las condiciones comerciales de un Gimnasio. Un Gimnasio puede dejar de usar el Servicio en cualquier momento. Un Estudiante puede eliminar su perfil desde la página Cuenta o pedir al Gimnasio que lo haga. Lo que ocurre con los datos después se describe en la Política de privacidad. Las secciones que por su naturaleza deban continuar (por ejemplo propiedad intelectual, exclusión de garantías, limitación de responsabilidad y ley aplicable) sobreviven a la terminación.

12. Exclusión de garantías

En la medida que la ley lo permita, el Servicio se presta "tal cual" y "según disponibilidad", sin garantías de ningún tipo más allá de las que no se pueden excluir. Nada de estos Términos limita los derechos que tienes como consumidor según la ley colombiana, incluida la Ley 1480 de 2011 (Estatuto del Consumidor).

13. Limitación de responsabilidad

En la medida que la ley lo permita, Gym Register no responde por daños indirectos, incidentales, especiales o consecuenciales, ni por pérdida de utilidades, ingresos, datos o reputación. Nosotros prestamos el Servicio a los Estudiantes sin costo; en la medida que la ley lo permita, nuestra responsabilidad total frente a un Estudiante se limita en consecuencia. Frente a un Gimnasio, nuestra responsabilidad total por todas las reclamaciones relacionadas con el Servicio se limita al monto que ese Gimnasio nos pagó en los doce meses anteriores al hecho que dio origen a la reclamación. Nada en estos Términos excluye o limita la responsabilidad que no pueda excluirse o limitarse por ley, incluida la derivada de fraude, dolo o culpa grave, o de muerte o lesiones personales causadas por nuestra culpa.

14. Indemnidad (gimnasios)

Un Gimnasio defenderá y mantendrá indemne a Gym Register frente a reclamaciones de terceros, y los costos relacionados, que surjan del contenido que el Gimnasio aporte, del tratamiento de datos personales por parte del Gimnasio sin la autorización que exige la ley, o del incumplimiento de estos Términos por el Gimnasio.

15. Cambios a estos Términos

Podemos actualizar estos Términos. La versión vigente siempre está en esta dirección con su fecha. Si un cambio es importante, lo notificaremos a los usuarios a través del Servicio o por otros medios de que dispongamos. Usar el Servicio después de que un cambio entre en vigor significa que aceptas los Términos actualizados. Si no los aceptas, deja de usar el Servicio y pide que se elimine tu cuenta.

16. Ley aplicable y controversias

Estos Términos se rigen por las leyes de la República de Colombia. Si tienes una inquietud, escríbenos primero para intentar resolverla de manera amistosa. Las controversias que no puedan resolverse así estarán sujetas a los jueces competentes de Colombia. Los consumidores conservan el derecho de acudir a la autoridad competente de protección al consumidor, y todas las personas conservan el derecho de presentar quejas ante la autoridad de protección de datos descrita en la Política de privacidad.

17. Disposiciones generales

Estos Términos, junto con la Política de privacidad y cualquier acuerdo comercial que tengamos con un Gimnasio, constituyen el acuerdo completo sobre el Servicio. Si alguna parte de estos Términos resulta inaplicable, el resto sigue vigente. No ejercer un derecho no implica renunciar a él. Podemos ceder estos Términos en relación con una transferencia del negocio; tú no puedes cederlos sin nuestro consentimiento. Estos Términos se ofrecen en español e inglés; si difieren, prevalece la versión en español.
